Woman sues Macy's over injury in purse department

GALVESTON - A Hitchcock woman seeks $100,000 in damages from Macy's Department Stores Inc. for injuries she reportedly sustained at the retail chain's Texas City store a year ago, recent court documents say.

According to a suit filed Feb. 12 in Galveston County District Court, Lucia Cantu was in the purse department of the defendant's store on Dec. 17, 2008, when an unsecured sign fell on her right foot, causing severe injuries.

"During the time that the plaintiff was upon the defendant's property, she was seriously injured as a result of a dangerous condition that existed," the original petition says.

"The large glass sign on the table with purses was not secured properly and presented a dangerous condition for the plaintiff."

Cantu claims her toes were fractured while her arm and general body were also hurt as a result of the alleged incident.

The suit faults Macy's for "failing to properly inspect the area in question, failing to maintain said area in a reasonably safe condition, and failing to give adequate and understandable warnings to the plaintiff."

Consequently, the plaintiff sues for pain and suffering, mental anguish, disfigurement and medical expenses.

She requests a jury trial.

Pasadena attorney Enrique Dovalina is representing Cantu.

Galveston County 10th District Court Judge David Garner is presiding over the case.
