Off-Duty Deputy Hurt after Struck by Car

HOUSTON - A Houston man is charged with aggravated assault on a public servant after allegedly striking a Harris County Sheriff's deputy with a car on Tuesday night.

Houston police say Don Jamar Boston, 25, was at the wheel of the vehicle that struck the deputy as he was driving away from a southwest Houston apartment complex.

The deputy who police say was struck by the car was one of two deputies working an off-duty security job at the Cambridge Crossing Apartments. Deputies told police that they were approaching Boston's car because they believed that the three people inside the vehicle were smoking marijuana or crack.

Houston Police Department spokesman Victor Senties says the deputies, who were not in uniform, had just identified themselves as peace officers when Boston put the car in gear and ran over one of the deputies, which prompted both deputies to draw their weapons.

"He was attempting to run over both of them," said Senties as he explained why both deputies opened fire on the car.

"Believing the vehicle to be a threat to himself and his partner, the fallen deputy draws his weapon and fires several shots. The deputy on the ground also draws his weapon and fires several shots."

The suspect allegedly continued to drive the car away from authorities. After an hour, police found the suspects when they contacted emergency medical help at the intersection of Ormandy Street near South Main Street.

All three people inside the car were apparently wounded by gunfire, said Senties on Wednesday morning. Boston was seriously wounded, although his injury is not thought to be life-threatening.

The two other people in the car, a 26- and 27-year-old woman, were treated and released from an area hospital. Senties said the two women are not facing any charges.

Police say no drugs were found with the suspects, but they believe the suspects had time to get rid of them before seeking medical help. Houston police are investigating the shooting because it took place in the city's jurisdiction.

Harris County Sheriff's Office spokeswoman Christina Garza says the Harris County Internal Affairs Division will investigate the shooting as well. Garza also says that it appears the deputies were justified in firing their weapons at the vehicle because it was posing an imminent threat to their safety. The deputy who was hit by the car was treated for cuts and bruises at the site of the shooting.
