Malpractice suit claims sponge left inside wound

A Nederland woman claims she suffered disfigurement after doctors left a sponge inside her abdominal wound.

Mandy Simon and her husband, Kevin, filed a lawsuit Nov. 4 in Jefferson County District Court against Coastal Home Health Care and Kinetic Concepts.

Simon claims she was being treated at her home by employees form Coastal Home Health on Nov. 12, 2007. The employees used a woundVAC on Simon following abdominal surgery, according to the complaint.

However, while employees were using the woundVAC, they left a sponge inside her wound, the suit states.

Kinetic Concepts is named as a defendant because it trained Coastal Home Health employees how to use the woundVAC.

As a result of the incident, Simon claims she has incurred medical costs; suffered severe physical impairment and disfigurement; sustained extreme physical and mental pain, suffering and anguish; and has experienced a deterioration of her physical and mental condition, the complaint says.

Kevin Simon claims he lost his wife's services, affection, solace, comfort, companionship, society, assistance and sexual relations.

The Simons are seeking an unspecified judgment and exemplary damages, plus pre- and post-judgment interest, costs and other relief the court deems just.

Brian D. Sutton, Joseph N. Jannise Jr. and Stephanie H. Harris of Sutton and Jacobs in Beaumont will be representing them.

The case has been assigned to Judge Milton Shuffield, 13th District Court.
