Travis County, TX offers 72-year old Woman $40k to Settle Taser Suit
Kathryn Winkfein, a 72-year-old woman from Travis County,Texas, has been offered a $40,000 settlement from the county in response to a tasering lawsuit she filed. The taser episode was captured on video and widely distributed throughout the country.
Winkfein had allegedly been tasered by a deputy constable after she dared him to use the taser during a traffic stop last May. Winkfein sued for $135,000 in pain and suffering, medical expenses and humiliation. In response, the country commissars approved the $40,000 counteroffer on Wednesday.
A 72-year-old woman who was hit with a Taser by a deputy constable accepted Travis County's $40,000 settlement offer, her lawyer said Monday. Kathryn Winkfein had sought more than $135,000 at one point. Both sides need to sign a settlement agreement, County Judge Sam Biscoe said. Deputy Constable Christopher Bieze stopped Winkfein on Texas 71 in western Travis County on May 11 for allegedly driving 60 mph in a 45-mph
The incident is being reviewed by the District Attorney's office, and a resisting-arrest charge is pending, according to Precinct 3 Constable Richard McCain. An internal investigation found no violations by the deputy constable, McCain said.
